DMCA Copyright Notice
Effective July 1, 2018
If you are a copyright owner (or represent such a copyright owner) and believe any user material posted on our site infringes upon your copyrights, you may file a notice of infringement with us under the Digital Millennium Copyright Act (“DMCA”) by sending a written notice that includes all of the following:
- The subject line says: “DMCA Copyright Notice”.
- Your contact information so that we can reply to your notice, including your full name, mailing address, telephone number, and email address, also provide, if possible, reasonably sufficient to permit us to notify the owner or administrator of the web page that allegedly contains infringing material (telephone number, and email address preferred).
- A description of the copyrighted work that you believe have been infringed and information reasonably sufficient to permit us to locate the specific allegedly infringing material on our site, including the URL where the content appears, or other means of identifying the allegedly infringing content with particularity.
- A statement that you have a “good faith belief that the material that is claimed as copyright infringement is not authorized by the copyright owner, its agent, or the law.”
- A statement that “the information in the notification is accurate, and under penalty of perjury, the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.”
- Your physical signature on the notice.

We suggest that you consult your legal adviser before filing a DMCA Notice. Please note that you may be liable for damages if you make a false claim of copyright infringement. Section 512(f) of the Copyright Act provides that any person who knowingly materially misrepresents that material is infringing may be subject to liability.
Santa Clara County REALTOR® Foundation may elect to not respond to DMCA Notices that do not substantially comply with all of the foregoing requirements and may elect to remove or disable access to the allegedly infringing material that comes to its attention via notices that do not substantially comply with the DMCA.
